It is important to recognize that child support payments are for the benefit of the child and that courts have discretion to deviate from child support guidelines. Some of the common reasons for deviating from child support guidelines include:

  • Custody arrangements that grant the non-custodial parent custody that is substantially in excess of that customarily approved or ordered by the court
  • Excessive transportation cost paid by one parent to meet visitation requirements in the divorce agreement
  • Significant tuition and other education expenses incurred prior to a child's reaching the age of majority
  • Assets of, or unearned income received by or on behalf of, a child or children

Child support is typically paid until a child reaches the age of majority, nineteen, unless the child gets married, is self supporting, or is emancipated. In most cases a custodial parent may petition the court for post-majority support to help pay for college.
