Modification of Child Support and Custody

Experienced Alabama Post-Divorce Modification Lawyers

Circumstances change as what was in the best interests of a child at the time of a divorce may no longer be in that child's best interests. At Gina H. McDonald & Associates, L.L.C., in Birmingham, Alabama, we have significant experience representing parents seeking modifications of child custody and child support orders. Our attorneys routinely help parents assess the changes in their circumstance to determine whether a request for modification will be granted.

Child support and child custody orders may be modified only by court order. Alabama courts require material changes in the circumstances of either parent to grant changes in custody or support. Requests for changes in custody must show that the living circumstances of the child have changed significantly. Physical abuse, drug use, and alcohol abuse are common reasons for modifying existing child custody arrangements.

In many cases, parents agree to changes in child custody, visitation schedules, or child support without involving the court or lawyers. This often seems easier than going to court, but gives a tremendous advantage to one parent as they can leverage those changes to manipulate their former spouse. When parents agree to a support or custody modification, it should be presented to a judge and amended in a divorce agreement.

We work closely with our clients to understand how their circumstances have changed and understand how to present changes to the court to achieve our client's goals. While we strive to gain agreement from both parents prior to presenting a modification request to the court, our attorneys have significant experience litigating modification actions that they will not hesitate to utilize if necessary.
